If you are entering into these Terms on behalf of an entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Services.
You must be at least the age of majority in your jurisdiction and legally capable of entering into binding agreements.
You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.
Outputs generated by AI or automation features may be probabilistic and can contain errors. You remain responsible for reviewing outputs and ensuring appropriate human oversight, especially for high-risk or regulated use cases.
The Services, including software, designs, and content, are owned by or licensed to Fractz and are protected by intellectual property laws. No rights are granted except as expressly stated.
You retain ownership of content you submit. You grant Fractz a non-exclusive, worldwide, royalty-free license to host, process, and display such content solely to provide the Services.
Where applicable, you agree to pay fees in accordance with the plan you select. Fees are non-refundable except where required by law or expressly stated.
Each party agrees to protect the other’s confidential information and to use it only for the purpose of providing or receiving the Services.
We process personal data in accordance with our Privacy Policy and applicable law, including GDPR where applicable.
You are responsible for having a lawful basis for personal data you submit to the Services and for complying with your own regulatory obligations.
Certain features may integrate third-party services. Use of such services is subject to their terms, and Fractz is not responsible for third-party content or practices.
Beta features are provided “as is,” may be modified or discontinued at any time, and may be subject to additional terms.
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Fractz disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Fractz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill.
You agree to indemnify and hold harmless Fractz and its affiliates from any claims, liabilities, damages, and expenses arising from your use of the Services or violation of these Terms.
We may suspend or terminate your access if you breach these Terms or if required by law. You may stop using the Services at any time.
These Terms are governed by the laws of the jurisdiction where Fractz is established, without regard to conflict of law rules. Courts in that venue have exclusive jurisdiction.
We may update these Terms from time to time. Material changes will be posted with a new “Last Updated” date. Continued use indicates acceptance.
